IronMile Studio terms

These terms are an agreement between IronMile Mobile Solutions LLC, a Michigan limited liability company based in Novi, Michigan ("IronMile", "we", "us"), and the business that signs up for IronMile Studio ("you"). We've written them in plain English. If anything here is unclear, email us at info@ironmilemobile.com before you sign up.

IronMile Studio is for businesses. By using it you confirm that you're acting for a business and that you have the authority to accept these terms for it.

1. What the service is

IronMile Studio is a hosted web configurator for your products: buyers choose options in 3D, see a price, view the product in augmented reality (AR) on their phone, and send you a quote request. You get an admin page with a quote inbox and a price editor, and on some plans visit stats, store integration and other features. What each plan includes is listed on our pricing page.

We build your configurator from your public product pages, drawings and price lists, or from files you send us. You review it on a private link before it goes live.

2. Free trial

Once your configurator goes live, it runs free for 30 days. We don't ask for a card. Before the trial ends we ask whether you want to keep it. If you choose a plan, billing starts then. If you don't, we take the configurator offline and you owe nothing.

3. Plans and billing

Plans are billed in advance, either monthly or annually, in US dollars. Prices don't include sales tax or similar taxes, which we add where required.
Your plan renews automatically at the end of each month or year until you cancel.
Custom work is priced in a written quote you accept before we start.
If we change our prices, we'll email you at least 30 days before the change applies to you. It applies from your next renewal, never in the middle of a period you've paid for.
If a payment fails, we'll let you know. If it isn't sorted out within 14 days, we may pause your configurator until it is.

4. Cancellation

You can cancel at any time from the Billing tab in your admin, or by emailing us. Cancellation takes effect at the end of your current billing period (the month or the year you've paid for), and your configurator stays live until then. Refunds are covered in our refund policy.

We may end the service for you with 30 days' notice by email; in that case we refund any fees you've paid for time after the service ends. We may suspend or end it sooner if you seriously breach these terms, for example under "Acceptable use" below.

5. Your prices and claims are your responsibility

The configurator shows your products, options, prices and descriptions. You are responsible for them:

Check your configurator before it goes live and whenever it changes. You are responsible for the prices, specifications, product claims, warranties and availability it shows, and for keeping them accurate and lawful.
A quote request is between you and your buyer. We aren't a party to any sale, quote or contract between you and your buyers, and we don't handle their payments.
AR shows the product at true size on the buyer's phone, but phone tracking can be off. It's a planning aid, not a site survey or a substitute for measuring.
You confirm that you have the right to use the content you give us (photos, drawings, CAD, logos, text) and you let us use it to build and run your configurator.

6. Acceptable use

Please don't use IronMile Studio to:

sell anything unlawful, or make false or misleading claims about your products or prices;
publish content you don't have the rights to, or that infringes someone else's trademarks, designs or copyrights;
collect buyers' information for anything other than responding to their requests, or send them spam;
interfere with the service, test its security without our written permission, overload it, or try to get at other customers' data;
resell or rebrand the service for others without a written agreement with us.

7. Your data

Quote requests are yours. We store and process them only to run the service for you. We don't sell them, share them with other customers, or contact your buyers.
Deleted on request. Ask us and we'll delete your quote requests. Before we do, you can ask for a copy.
Visit stats are counted without cookies and without storing IP addresses.
Your source CAD files are never published. Only the display models needed to show your product go on the web.
We use service providers (for example, cloud hosting and email delivery) to run IronMile Studio. They handle data only to provide their services to us.

8. Who owns what

You own your brand, your product information, your files and your quote requests. We own the IronMile Studio software, templates and tools. The 3D models we make of your products are made for your configurator; we won't use them for anyone else's product or show them publicly without your permission.

9. No guarantees

We work hard to keep IronMile Studio fast and available, but we can't promise it will always be uninterrupted or error-free. Apart from what these terms say, the service is provided "as is", without warranties of any kind, to the extent the law allows.

10. Limits on liability

To the extent the law allows, neither of us is liable to the other for indirect or consequential losses, such as lost profits or lost sales, and our total liability under these terms is limited to the fees you paid us in the 12 months before the claim. You agree to cover us against claims from third parties arising from your products, prices, claims or content.

11. Changes to these terms

If we change these terms, we'll update the date at the top and email you at least 30 days before a material change applies to you. If you don't agree with a change, you can cancel before it takes effect.

12. Governing law

These terms are governed by the laws of the State of Michigan, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Michigan.
